Monday Musings ...lawyers

 Flashback to 2004, there is a young person who is an undergraduate student. Between juggling classes, studying, time with friends and newly discovered freedom, this young person had a few overdraft fees.

This was not an isolated incident. Hundreds of individuals were experiencing the same identical situation. What situation? Customers had incurred overdraft fees that they viewed as suspicious.  Most individuals viewed the overdraft fees a result of poor recording keeping on their part. They chalked up the issue as a lesson learned.  

Others sought to determine if there has been wrongdoing. Someone sought the advice of an attorney. A class action suit was initiated.

The settlement…

“******  Third Bank has agreed to a 9.5 million settlement of a class action lawsuit concerning the way it issues overdraft fees.” *

I wonder how many folks were surprised to discover hefty checks in their mailbox.  Individuals could receive up to three times the amount they were charged from the class action settlement.
